Foreigners married to Japanese nationals and children of Japanese nationals (including specially adopted children) are eligible to obtain a residence status as “Spouse or Child of a Japanese National.” Foreigners with this residence status have no restrictions on employment and are free to choose their occupation. However, in order to prevent sham marriages, authorities tend to conduct strict reviews to confirm that the couple is actually living together as a married couple.

FAQ

Q: I have completed the marriage procedures in Japan, but my spouse has not yet completed the procedures in their home country (foreign country). Is it still possible to apply for a spouse visa in such a case?

A: As a general rule, before applying for a “Spouse of a Japanese National” visa, it is necessary to complete the marriage procedures in the spouse's home country (foreign country). As an exception, in cases where the spouse is a U.S. citizen and the marriage procedures in Japan have been completed first, it is possible to complete the procedures in the spouse's home country by notifying the U.S. Embassy in Japan. The marriage procedures required for visa application vary depending on the nationality of the spouse, so please consult with us.

Q: I have a residence status as a “Spouse of a Japanese National,” but I am now divorced. Are there any procedures I need to take to continue staying in Japan?

A: If there is no valid reason, your residence status may be revoked six months after divorce or death. It may be necessary to change your residence status to “Long Term Resident (Teijyusha)” or similar.

Q: I am an adopted Japanese citizen. Can I obtain a residence status as a “Spouse or Child of a Japanese National”?

A: Only special adoptions that terminate the family relationship with the biological family are eligible. Therefore, ordinary adoptions are not eligible.

Q: Is it not possible to obtain a residence status as a “Spouse of a Japanese National” if you do not live with a Japanese national?

A: Unless there are special circumstances, you will need to live together. If you do not live together, you will need to provide an explanation in writing.

Q: What documents are required to obtain a residence status as a “Spouse or Child of a Japanese National”?

A: You will need an application form for a Certificate of Eligibility, a return envelope, a marriage certificate, a copy of your resident card, a copy of your family register, a tax certificate, a questionnaire, a statement of reasons for your application, and supporting documents such as snapshots.
